Business Rates Headache for Landlords?- SHW Business Rates Team have the Cure!

Landlords using the charity PSCT’s WiFi transmitters to avoid empty property rates will have to think again as the High Court has now ruled that the charity were not using the premises for ‘wholly or mainly charitable purposes’ and were therefore not entitled to claim charitable rates relief. With over a 1000 leases across the country this huge blow to PSCT, and potentially astronomical rates bill, means that landlords will have to look at other alternatives if they wish to mitigate their own liabilities as, presumably, PSCT are terminating their leases/licences as this is being written!

Less ‘Red Tape’ in Town Planning from 30th May 2013

The key question many clients have been asking of late is:
“when can offices change to housing ‘without’ the need for a conventional planning permission?”
Changes to the General Permitted Development Order 1995 take effect from 30th May. The changes will radically reduce the rules on change of use including allowing the direct change of use of office buildings B1(a) to residential use C3 without the need for conventional planning permission. In addition further changes are made with regard high-street properties, town centre offices and agricultural buildings and relate to England only.

Further court ruling on Empty Property Rates

Business Rates Following the recent High Court decision in the Makro case where occupation of just 0.2% of the property was deemed to be enough to trigger a further period of empty property relief upon vacation, there has been another decision in a Cheshire Magistrates Court to add further pressure on the Government to change the way that Business Rates are charged on Empty Properties.

This was one of a sequence of meetings attended by a number of key parties involved in the development industry within Brighton & Hove and wider afield.
